Annual Leave (الإجازة السنوية): Tiers, Accruals, and Scheduling

Annual leave is a fundamental statutory right designed to guarantee rest, physical recuperation, and workplace productivity. Under Egyptian Labor Law, annual leave entitlement is tiered based on seniority, age, and working conditions:

  • First Year of Service (Post 6 Months): For employees completing 6 continuous months with the employer, annual leave accrues proportionally (equivalent to 15 days on an annualized basis).
  • Standard Annual Entitlement (21 Days): 21 full paid days per calendar year for employees who have completed one full continuous year of service.
  • Seniority & Age Tier (30 Days): 30 full paid days per calendar year for any employee who has completed 10 continuous years of service (across one or multiple employers) OR who has reached 50 years of age.
  • Hardship & Remote Areas Tier (45 Days): 45 full paid days for employees engaged in arduous, hazardous, or unhealthy work, or stationed in remote geographical regions designated by ministerial decree.

Scheduling Powers, Accumulation, and Cash Compensation

While the employer holds the statutory right to schedule the timing of annual leaves based on operational requirements, the law imposes strict boundaries to protect employee welfare:

Statutory Rules Governing Annual Leave Administration

  • Mandatory Minimum Period: The employee must take at least 15 continuous days of annual leave each year, including an uninterrupted block of at least 6 consecutive working days.
  • Carrying Forward Leave: Leave balances may be carried forward upon mutual written agreement, provided the employee does not forfeit their accrued statutory rights.
  • Leave Encashment at Termination: Upon contract termination or retirement, the employer must settle the monetary value of all accrued, unused annual leave balances calculated on the employee's final comprehensive wage.
  • Refusal of Written Leave Request: If an employee submits a formal written request for annual leave and the employer refuses or postpones it for operational reasons, the employer is legally obligated to encash the denied leave balance.

Casual, Official, Examination, and Pilgrimage Leaves

Beyond the annual leave pool, Egyptian Labor Law codifies distinct statutory leaves for personal emergencies, statutory civic holidays, and life milestones:

  • Casual Leave (الإجازة العارضة): Up to 6 days per calendar year for unforeseen personal emergencies, taken for a maximum of 2 days per single occasion. Casual leave days are deducted from the employee's annual leave quota but require prompt notice rather than prior approval.
  • Official National Holidays (الأعياد الرسمية): Paid holidays decreed by the Prime Minister (typically 13-14 days annually). If an employer requires work on an official holiday due to business necessity, the employee is entitled to double pay (أجر مضاعف) or an alternate paid day off.
  • Pilgrimage Leave (إجازة الحج وزيارة بيت المقدس): One full month (30 days) with full pay, granted once in an employee's working lifetime after completing 5 continuous years of service with the employer.
  • Examination Leave (إجازة الامتحانات): Employees enrolled in accredited schools or universities are entitled to paid study leave matching the official examination schedule, provided prior proof of exam entrance is submitted.

Sick Leave Framework and Maternity Rights

Under Labor Law No. 14/2025 and Social Insurance Law No. 148/2019, sick leave is structured through statutory medical insurance coverage, while maternity protections safeguard working mothers:

Statutory Sickness & Maternity Checklist

  • Sick Leave Pay Tiers (Up to 180 Days): Certified by the competent Health Insurance Organization (HIO): 75% of wage for the first 90 days, increasing to 85% for the following 90 days, funded through social insurance.
  • Chronic & Critical Illnesses: Employees afflicted with chronic illnesses (أمراض مزمنة) receive 100% full wage compensation from the Social Insurance Fund until full recovery or medical disability determination.
  • Maternity Leave (4 Months): Female employees are entitled to 4 months of fully paid maternity leave (covering pre- and post-natal periods), applicable up to three deliveries during their career.
  • Daily Nursing Hours: A daily paid nursing break of one hour (or two half-hours) for 24 months following the date of delivery, without any wage deduction.
  • Unpaid Childcare Leave: In enterprises employing 50 or more workers, female employees may take up to 2 years of unpaid childcare leave, exercisable up to three times throughout service.
