Statutory Baseline: Standard Hours vs. Maximum Daily Presence

Egyptian Labor Law No. 14 of 2025 establishes clear statutory boundaries governing daily working hours to protect employee safety and maintain balanced productivity:

  • Standard Working Hours: Actual working hours must not exceed 8 hours per day or 48 hours per week (excluding designated meal and prayer breaks).
  • Intermittent Work (الأعمال المتقطعة): Under Ministerial Decrees 289 and 290 of 2025, for jobs inherently punctuated by waiting periods or operational pauses, daily presence may be extended up to a strict maximum of 12 hours per day.
  • Absolute Presence Ceiling: Under no circumstances may an employee's total presence in the workplace exceed 12 hours in any single 24-hour cycle.
  • Notification of Extraordinary Conditions: Under Article 121, employers may mandate overtime to address extraordinary business necessity or emergencies, provided the competent labor office is formally notified within 7 working days.

The Statutory Overtime Calculation Formulas

Article 121 of Law No. 14/2025 establishes distinct statutory compensation tiers for overtime based on the time of day when work is performed:

Statutory Overtime Premium Multipliers

  • Daytime Overtime (+35%): Work performed during daylight hours (typically between 6:00 AM and 6:00 PM) is compensated at the normal hourly rate PLUS a minimum of 35% (Multiplier: 1.35x).
  • Nighttime Overtime (+70%): Work performed during nighttime hours (defined as work occurring after 6:00 PM or post 9:00 PM depending on shift classification) is compensated at the normal hourly rate PLUS a minimum of 70% (Multiplier: 1.70x).
  • Work on Weekly Rest Days (Day Off): If an employee is required to work on their statutory weekly rest day, they are entitled to double pay (مثل أجره / +100%) for that day, AND the employer must grant a substitute paid day off during the following week.

Practical Numerical Example: Monthly Overtime Breakdown

To illustrate the exact mathematical application under Egyptian labor rules, consider an employee earning a base monthly wage of EGP 10,000 who worked 10 daytime overtime hours and 5 nighttime overtime hours in a given month:

  • Step 1: Calculate Total Standard Monthly Hours: Standard working days per month = 26 days (6 days/week × 4 weeks). Total standard monthly hours = 8 hours/day × 26 days = 192 hours.
  • Step 2: Calculate Base Hourly Wage: EGP 10,000 ÷ 192 hours = EGP 52.08 per hour.
  • Step 3: Calculate Daytime Overtime Rate: EGP 52.08 + (35% × EGP 52.08) = EGP 70.31 per daytime overtime hour.
  • Step 4: Calculate Nighttime Overtime Rate: EGP 52.08 + (70% × EGP 52.08) = EGP 88.54 per nighttime overtime hour.
  • Step 5: Compute Total Monthly Overtime Due: (10 day hours × EGP 70.31 = EGP 703.10) + (5 night hours × EGP 88.54 = EGP 442.70) = EGP 1,145.80 in overtime dues.
  • Step 6: Total Monthly Gross Compensation: EGP 10,000 + EGP 1,145.80 = EGP 11,145.80 gross pay.

Common Legal & Accounting Pitfalls to Avoid

Payroll Risk Management Checklist

  • Base Wage vs. Gross Salary Confusion: Under statutory law, overtime is computed on the employee's basic wage. Variable allowances (such as transport, housing, or discretionary bonuses) are excluded unless the employment agreement explicitly specifies calculation on gross salary.
  • Failure to Distinguish Night Differentials: Applying a flat 35% rate to all overtime hours without applying the mandatory 70% rate to hours worked during nighttime constitutes an actionable statutory wage underpayment.
  • The 'Inclusive Salary' Trap: Contracts containing clauses stating 'the salary covers all necessary overtime' are strictly scrutinized by labor courts and will be invalidated if hours exceed reasonable operational standards.
  • Flat Overtime Allowances: Paying an arbitrary flat monthly allowance (بدل إضافي ثابت) creates severe legal exposure when actual extra hours performed exceed the flat sum.
